By creating an account or using CreativeArc ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms form a legally binding agreement between you and CreativeArc ("we", "our", "us"). CreativeArc is operated by the team at creativearc.ai, reachable at support@creativearc.ai.
You must be at least 18 years old to use CreativeArc. By using the Service, you confirm that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@creativearc.ai if you suspect unauthorised access.
You may not share your account with others, use another person's account, or create accounts for the purpose of circumventing usage limits or credit systems.
Credits are consumed each time you use a generation feature (image, video, 3D, world generation, upscale, background removal). Credit costs are shown before each operation.
Subscription plans include a monthly credit allocation. Unused monthly plan credits roll over into the next billing period and may accumulate up to a maximum of three times the plan's monthly allowance. Top-up credits purchased separately are valid for 12 months from the date of purchase. Buying further top-up credits extends the expiry of your whole top-up balance by a further 12 months. Expired credits are removed from your balance and are not refundable.
14-day cancellation right-under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a new subscription within 14 days of purchase without giving a reason. However, by starting to use CreativeArc immediately after purchase, you expressly request that we begin providing the service before the cancellation period expires. If you exercise your right to cancel after service has begun but before 14 days, we may charge a pro-rata amount for the service provided up to the point of cancellation. Cancelling your subscription-you may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period; you retain access and your credit allocation until that date.
Refunds-subscription fees are non-refundable outside the 14-day cancellation window. Credits consumed due to a platform error are automatically refunded. Contact support@creativearc.ai for billing disputes; we aim to respond within 5 business days.
We reserve the right to change pricing with at least 30 days' notice to active subscribers.
Your use of CreativeArc is governed by our Acceptable Use Policy, which forms part of these Terms. By using the Service you agree to comply with it in full.
In summary, you must not use CreativeArc to generate illegal content, content sexualising minors, non-consensual intimate imagery, or content that infringes third-party rights. Full details, including zero-tolerance violations and consequences, are set out in the Acceptable Use Policy.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity.
Your content-you retain ownership of images and files you upload to CreativeArc. You grant us a limited, non-exclusive licence to process, store, and display them solely to provide the Service.
Generated outputs-subject to the terms of the underlying AI model providers, you own the outputs generated using your credits. It is your responsibility to ensure generated content complies with applicable laws and does not infringe third-party rights.
CreativeArc platform-all software, UI, branding, and documentation belong to CreativeArc. You may not copy, modify, or distribute them without our written consent.
We do not use your uploaded or generated content to train AI models.
CreativeArc provides AI generation tools. Outputs are probabilistic and may be inaccurate, incomplete, or unsuitable for a specific purpose. We do not guarantee that generated images, 3D models, videos, or immersive worlds will meet your requirements.
You are solely responsible for reviewing and validating AI-generated outputs before use in any professional, commercial, or client-facing context. CreativeArc is a creative tool, not a substitute for professional judgment.
We aim for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime due to third-party infrastructure (cloud providers, AI model APIs).
We are not liable for losses arising from Service unavailability, generation failures, or delays caused by third-party AI providers.
You may optionally connect your own API keys for supported AI providers. By doing so, you accept that:
Organisation owners are responsible for managing member access and ensuring all members comply with these Terms. Organisation credits are shared among members, and the owner is responsible for all usage charges incurred.
To the maximum extent permitted by law, CreativeArc's total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, special, or consequential damages including loss of profits, data, or business opportunities, even if advised of the possibility of such losses.
You agree to indemnify and hold CreativeArc harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
You may delete your account at any time from Settings → Security. Account deletion is initiated immediately upon your request-your subscription is cancelled and the removal of all stored files and account data begins at that point. This process completes as part of the same operation in most cases; in rare circumstances where a step cannot complete immediately (for example, due to a temporary storage provider issue), any remaining data will be fully removed within 30 days. Deletion is irreversible. See our Privacy Policy for further details.
We may suspend or terminate your account for violations of these Terms, non-payment, or at our discretion with 30 days' notice for non-violation cases. In cases of serious violation (e.g. illegal content), termination may be immediate without notice or refund.
Unused monthly subscription credits at the time of termination are non-refundable. Top-up credits may be refunded at our discretion; contact support@creativearc.ai.
We may update these Terms from time to time. We will notify you by email or via in-app notice at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England and Wales, unless mandatory consumer protection laws in your country of residence require otherwise.
